1. ALLM\u00c4NNA BEST\u00c4MMELSER<\/strong><\/h4>\n\n

MUSIC ALLIGATOR LTD, nedan kallad “Moderatorn”, erbjuder h\u00e4rmed personer som \u00e4r intresserade av dess tj\u00e4nster (nedan kallad “Kunden”) m\u00f6jligheten att ing\u00e5 ett serviceavtal (nedan kallat “Avtalet”).<\/p>\n\n

Accept av villkoren i detta erbjudande sker i samband med betalning av tj\u00e4nsterna i enlighet med vald tj\u00e4nst.\nGenom att acceptera villkoren nedan och g\u00f6ra betalningen accepterar den person som utf\u00f6r dessa \u00e5tg\u00e4rder detta erbjudande och blir kund.\nL\u00e4s d\u00e4rf\u00f6r noggrant igenom avtalstexten och om du inte h\u00e5ller med om n\u00e5got villkor f\u00f6resl\u00e5r Moderatorn att du avst\u00e5r fr\u00e5n att ing\u00e5 avtalet och utf\u00f6ra n\u00e5gra \u00e5tg\u00e4rder som syftar till att ta emot tj\u00e4nster. <\/p>\n\n

Fullst\u00e4ndig och ovillkorlig accept av detta erbjudande inneb\u00e4r att Kunden godk\u00e4nner villkoren i Avtalet genom att kryssa i rutan “Jag accepterar villkoren i Public Offer Agreement f\u00f6r modereringstj\u00e4nster”.<\/p>\n\n

2. TERMER OCH DEFINITIONER<\/strong><\/h4>\n\n

I detta erbjudande, om inte sammanhanget kr\u00e4ver annat, har f\u00f6ljande termer f\u00f6ljande betydelser:<\/p>\n\n

– “Erbjudande” – ett offentligt f\u00f6rslag fr\u00e5n Moderatorn, riktat till en person, om att ing\u00e5 ett avtal med denne p\u00e5 de befintliga villkor som anges i Kontraktet, inklusive alla bilagor till detta.<\/p>\n\n

– “Kund” – en person som har ing\u00e5tt ett avtal med Moderatorn p\u00e5 de villkor som anges i avtalet (juridisk person, enskild person, enskild f\u00f6retagare).<\/p>\n\n

– “Godk\u00e4nnande” – Kundens fullst\u00e4ndiga och ovillkorliga godk\u00e4nnande av Avtalsvillkoren.<\/p>\n\n

– “Service” – modereringstj\u00e4nst f\u00f6r en musikutg\u00e5va.<\/p>\n\n

– “Moderering” – processen f\u00f6r att kontrollera en musikutg\u00e5va som laddats upp av kunden till deras personliga konto f\u00f6r \u00f6verensst\u00e4mmelse med de krav som st\u00e4lls av moderator.<\/p>\n\n

– “Music Release” – en upps\u00e4ttning musikaliska kompositioner som kombinerats av Kunden f\u00f6r uppladdning f\u00f6r moderering.<\/p>\n\n

– “Internettj\u00e4nst (plattform)” – h\u00e5rdvara och programvara som \u00e4r integrerad med webbplatsen.<\/p>\n\n

– “Moderatorns webbplats” – httpss:\/\/musicalligator.com<\/u>\/<\/u><\/a>.<\/p>\n\n

– “Krav f\u00f6r musikrelease”:<\/p>\n\n

– Originalitet.\n\u00d6verensst\u00e4mmelse med tredje parts exklusiva och\/eller upphovsr\u00e4ttsliga r\u00e4ttigheter till musikutg\u00e5van, dess omslag och annat material som \u00e5tf\u00f6ljer musikutg\u00e5van. <\/p>\n\n

– Coverversioner av l\u00e5tar.\nEndast lagliga och officiella covers med licensavtal fr\u00e5n upphovsr\u00e4ttsinnehavare accepteras.\nSoundtracks, coverversioner eller hyllningsl\u00e5tar som \u00e4r mycket lika originalet \u00e4r inte till\u00e5tna. <\/p>\n\n

– Ljudsp\u00e5ret ska inte vara ett kort ljudfragment, ett sampel eller en specialeffekt (FX).<\/p>\n\n

– Varaktighet.\nDen acceptabla sp\u00e5rl\u00e4ngden \u00e4r mer \u00e4n 1 minut, med undantag f\u00f6r “Skit” eller “Intro” versioner. <\/p>\n\n

– Kvalitet.\nDet finns inga ljudf\u00f6rvr\u00e4ngningar, pauser, avbrott eller andra ljudfel i musikutg\u00e5van.\nInspelningar av l\u00e5g kvalitet \u00e4r inte till\u00e5tna (v\u00e4sande, d\u00e5lig inspelning, oprofessionellt gjorda och mixade sp\u00e5r, glitchar, osk\u00e4rpa, avsaknad av ljud, osynkroniserat ljud). <\/p>\n\n

– Kulturella \u00f6verv\u00e4ganden.\nHatpropaganda baserad p\u00e5 ras, religion, k\u00f6n, sexuell l\u00e4ggning, nationellt\/etniskt ursprung eller andra egenskaper \u00e4r inte till\u00e5ten.\nDet \u00e4r ditt ansvar att bekanta dig med lokala lagar och kulturella normer.\nInneh\u00e5llet m\u00e5ste vara lagligt och \u00f6verensst\u00e4mma med de moraliska normerna i det land eller den region d\u00e4r sp\u00e5ret kommer att spelas. <\/p>\n\n

– Material som inneh\u00e5ller \u00f6verdrivet st\u00f6tande inneh\u00e5ll, drogpropaganda, diskussioner om rasistiska eller politiska \u00e4mnen, f\u00f6rol\u00e4mpningar \u00e4r inte till\u00e5tet.<\/p>\n\n

– “Tj\u00e4nster” – en upps\u00e4ttning tj\u00e4nster och deras kostnad, publicerade p\u00e5 Internet p\u00e5 httpss:\/\/musicalligator.com\/public-offer\/<\/a>. Kunden \u00e4r ansvarig f\u00f6r att sp\u00e5ra \u00e4ndringar i tj\u00e4nsterna. <\/p>\n\n

3. F\u00d6REM\u00c5LET F\u00d6R AVTALET<\/strong><\/h4>\n\n

3.1.\nThe Moderator provides the Customer with services according to the Service chosen by the Customer, indicated at the link httpss:\/\/musicalligator.com\/public-offer\/<\/a>, and the Customer pays for these services. <\/p>\n\n

3.2.\nIf the Moderator makes changes to the Services, services to the Customer continue to be provided based on the service that they selected and paid for. <\/p>\n\n

4. TIDSPERIOD F\u00d6R TILLHANDAH\u00c5LLANDE AV TJ\u00c4NSTER<\/strong><\/h4>\n\n

4.1.\nThe term of service provision depends on the selected service. <\/p>\n\n

5. KOSTNADER F\u00d6R TJ\u00c4NSTER OCH BETALNINGSF\u00d6RFARANDE<\/strong><\/h4>\n\n

5.1.\nThe cost of services depends on the selected service. <\/p>\n\n

5.2.\nPayment for services is made on the Moderator\u2019s website by cashless transfer of funds to the Moderator\u2019s details specified on the website. <\/p>\n\n

5.3.\nThe moment of payment is considered the moment when funds are received in the Moderator\u2019s bank account. <\/p>\n\n

6. PROCESS F\u00d6R TILLHANDAH\u00c5LLANDE AV TJ\u00c4NSTER<\/strong><\/h4>\n\n

6.1.\nThe Customer selects a Service and makes payment for services in accordance with the Service. <\/p>\n\n

6.2.\nAfter payment, the Customer sends the music release to the Moderator for service provision through their personal account in the online service. <\/p>\n\n

6.3.\nUpon receiving payment for the services, the Moderator begins to provide the services. <\/p>\n\n

6.4.\nThe result of the provided services for Moderation is one of the following decisions made by the Moderator regarding the music release: <\/p>\n\n

6.4.1.\nApproval of the music release for its further use (if the music release meets the requirements of the Agreement); <\/p>\n\n

6.4.2.\nRefusal to approve the music release for further use (if the music release has violations); <\/p>\n\n

6.4.3.\nSending the music release for revision (if the music release has defects or infringes the rights of third parties). <\/p>\n\n

6.5.\nIn case the music release is sent for revision for reasons specified in section 6.4.3.\nof the Agreement, the Customer has the right within 3 calendar days from receiving notification from the Moderator to provide documents of title to the disputed result of intellectual activity. <\/p>\n\n

6.5.1.\nIf documentary evidence that meets the requirements of the law is provided within the specified period, the provision of services regarding the music release will continue. <\/p>\n\n

6.5.2.\nIf documentary evidence is not provided within the specified period, services regarding the music release are considered to have been provided.\nIn this case, the cost of services is non-refundable. <\/p>\n\n

6.6.\nIn case of refusal to approve the music release for further use, the cost of services is non-refundable.\nResending such a music release for moderation means the provision of services regarding this music release from the beginning. <\/p>\n\n

7. MODERATORNS ANSVAR<\/strong><\/h4>\n\n

7.1.\nThe Customer understands and agrees that the final decision on including the music release in playlists is made by platform editors, so the Moderator is not responsible for a platform\u2019s refusal to include the music release in playlists. <\/p>\n\n

7.2.\nThe Moderator provides services according to the Service chosen by the Customer and is not responsible for the Customer\u2019s infringement of third-party rights, as well as for violation of other requirements for music releases established by legislation. <\/p>\n\n

7.3.\nIn case the Customer violates the conditions on the ways of using the Moderator\u2019s online service, the Moderator has the right to unilaterally suspend the provision of Services, the Customer\u2019s access to the personal account on the Moderator\u2019s website or refuse to execute the Agreement and demand compensation for damages caused by the termination of the Agreement. <\/p>\n\n

8. \u00c4NDRINGAR AV VILLKOREN F\u00d6R ERBJUDANDET<\/strong><\/h4>\n\n

8.1.\nThe Moderator reserves the right to make changes to the terms of the Agreement and\/or withdraw the Agreement at any time at its discretion. <\/p>\n\n

8.2.\nIn case the Moderator makes changes to the Agreement, such changes take effect from the moment the amended text of the Agreement is posted on the Internet at httpss:\/\/musicalligator.com\/<\/a>, unless a different term for the changes to take effect is additionally defined at such posting. <\/p>\n\n

9. SLUTBEST\u00c4MMELSER<\/strong><\/h4>\n\n

9.1.\nThe Customer confirms that all terms of this Agreement are clear to him, and he accepts them unconditionally and in full. <\/p>\n\n

9.2.\nThis Offer-Agreement becomes effective upon the Customer\u2019s acceptance of the offer and remains in force until the parties fully fulfill their obligations. <\/p>\n\n

9.3.\nThe Moderator has the right to unilaterally refuse to provide Services if the Customer violates any terms of this offer. <\/p>\n\n

9.4. All changes, appendices, and additions to this Contract are its integral parts. <\/p>\n\n
